In Hemp Industries Association v. DEA, the Ninth Circuit ruled that the Drug Enforcement Agency has no authority to regulate non-psychoactive hemp products.

Hemp oil and seeds, which contain naturally-occurring THC not contained within or derived from marijuana, were held to be outside the definition of "THC" as included in Schedule I of the Controlled Substances Act.

Bottom line:
Hemp cosmetics and food, such as soap, nutrition bars, tortilla chips, pretzels, beer, candy bars, and margarine, are legal. Foodstuffs containing natural THC contained within marijuana, and/or synthetic THC, such as pot brownies, rasta pasta or ganja gooballs, are not.
